Terms of Use
Terms Governing Our Website and Services
These Terms and Conditions explain the rules for accessing our website, engaging our services, and interacting with Web Elevate.
Welcome to Web Elevate. These Terms and Conditions govern your access to and use of the Web Elevate website and the services we provide. By accessing our website, submitting an enquiry, or engaging our services, you agree to these terms. If you do not agree with these terms, please discontinue using our website.
1. About Web Elevate
Web Elevate provides digital services that may include website design and development, search engine optimisation (SEO), Generative Engine Optimisation (GEO), social media marketing and promotions, corporate branding and printing, AI solutions, business automation, and other related digital services.
The specific services, deliverables, fees, timelines, and responsibilities applicable to a project will be confirmed separately through a written proposal, quotation, statement of work, or service agreement where applicable.
2. Use of Our Website
You agree to use our website lawfully and responsibly. You must not use our website in a way that violates applicable laws, infringes the rights of others, disrupts website operations, attempts unauthorised access, or introduces malicious software or harmful material.
We may update, suspend, restrict, or discontinue any part of our website when reasonably necessary. We do not guarantee that the website will always be available, uninterrupted, or free from errors.
3. Services and Project Agreements
All services are subject to the agreed project scope, deliverables, pricing, payment terms, and timeline. Any additional work or changes requested outside the agreed scope may require a revised quotation, additional fees, or an adjustment to the project schedule.
We will make reasonable efforts to deliver services in accordance with the agreed requirements. Project timelines may depend on the timely provision of information, content, approvals, feedback, access credentials, and other materials required from you.
Unless otherwise agreed in writing, estimates and proposed delivery dates are indicative and may change where project requirements, dependencies, or circumstances change.
4. Client Responsibilities
You are responsible for providing accurate information, approved content, brand assets, instructions, and other materials necessary for the delivery of your project. You must ensure that you have the appropriate rights and permissions to use any material supplied to us, including text, images, videos, logos, fonts, and other intellectual property.
You are responsible for reviewing designs, website content, marketing materials, and other deliverables and providing feedback or approval within agreed timeframes. Delays in receiving required information or approvals may affect project delivery dates.
5. Fees and Payments
Service fees, deposits, payment schedules, applicable taxes, and other charges will be outlined in the relevant quotation, invoice, or service agreement. You agree to pay the amounts due in accordance with the agreed payment terms.
Additional requests, revisions beyond the agreed scope, third-party services, subscription fees, advertising expenditure, printing costs, hosting, domains, licences, and other external expenses may incur additional charges where applicable and as agreed.
If a payment dispute or overdue account arises, we will seek to resolve the matter in accordance with the applicable agreement and relevant laws. Any suspension of services, interest, recovery costs, or other remedies will apply only to the extent permitted by the applicable agreement and law.
6. Website Design and Development
Website design and development services may include design concepts, responsive layouts, website functionality, content integration, testing, and deployment, depending on the agreed scope.
Unless expressly included in the project agreement, ongoing maintenance, hosting, domain registration, software subscriptions, security monitoring, content updates, technical support, and future enhancements are not automatically included in the original project fee.
Websites may rely on third-party platforms, plugins, themes, APIs, hosting providers, and other technologies. We cannot guarantee the continued availability, compatibility, or performance of third-party products and services that are outside our control.
7. Digital Marketing, SEO and GEO
Our digital marketing services may include search engine optimisation, Generative Engine Optimisation, social media marketing, content optimisation, online promotions, and related activities.
Search engine rankings, website traffic, leads, conversions, advertising performance, social media engagement, and visibility in AI-generated responses depend on various factors, including competition, platform algorithms, market conditions, budget, and audience behaviour.
We do not guarantee specific search rankings, traffic volumes, sales, leads, advertising outcomes, or inclusion in AI-generated answers and recommendations. We aim to deliver services using appropriate strategies and reasonable professional care within the agreed scope.
Advertising platform charges, third-party subscriptions, paid promotional budgets, and other external marketing costs are separate from our service fees unless expressly included in writing.
8. AI Solutions and Automation
AI solutions and automation services may use third-party AI models, APIs, software platforms, integrations, and automated workflows. The availability, accuracy, output, and performance of these technologies may vary.
AI-generated outputs may contain errors, omissions, outdated information, or unsuitable recommendations. You are responsible for reviewing outputs and ensuring that their use is appropriate for your business, customers, and legal obligations.
AI automation should not replace appropriate human review where decisions may significantly affect individuals, finances, safety, legal rights, or other sensitive matters. You are responsible for ensuring that your use of AI and automated systems complies with applicable privacy, data protection, consumer, and other relevant laws.
9. Corporate Branding and Printing
Corporate branding and printing services may include logo design, brand identity materials, business stationery, brochures, promotional items, and other marketing collateral, as specified in the agreed scope.
You are responsible for checking and approving final artwork, spelling, contact details, colours, dimensions, quantities, and other production specifications before printing. Approval of final artwork confirms your acceptance of the supplied content and design for production.
Printed colours and finishes may vary slightly due to differences in screens, printing processes, materials, and production methods. Production timelines and delivery arrangements may depend on third-party printers and suppliers.
10. Intellectual Property
Unless otherwise agreed in writing, the intellectual property rights in our website, original website content, branding, graphics, design elements, and other materials created by or belonging to Web Elevate remain with their respective owners.
Ownership or licensing rights for project deliverables will be governed by the relevant proposal or service agreement. Where applicable, transfer of ownership or provision of final deliverables may be subject to full payment of all outstanding amounts.
You retain responsibility for the content and materials you provide and confirm that you have the necessary rights to authorise their use. You grant us permission to use those materials only as reasonably necessary to provide the agreed services.
Third-party software, stock assets, fonts, plugins, templates, and other licensed materials remain subject to their respective licence terms and may not be transferable.
11. Confidentiality and Privacy
We will take reasonable steps to protect confidential business information provided to us in connection with our services and will use it for purposes related to the project, service delivery, or other authorised purposes.
Personal information collected through our website or during the provision of our services will be handled in accordance with applicable privacy laws and our Privacy Policy, where available.
You should not submit sensitive personal information, passwords, financial account credentials, or other confidential data through general enquiry forms unless an appropriate secure process has been provided.
12. Third-Party Services and External Links
Our website or services may contain links to external websites or rely on third-party services, including hosting providers, payment services, social media platforms, analytics tools, advertising platforms, and AI providers.
Third-party services are governed by their own terms, policies, availability, and security practices. We do not control external websites or guarantee the accuracy, availability, or performance of third-party services.
13. Limitation of Liability
To the extent permitted by applicable law, Web Elevate will not be liable for indirect or consequential losses arising from the use of our website or services, including loss of profits, business opportunities, data, or anticipated savings, where such exclusions are legally permitted.
We are not responsible for disruptions, failures, losses, or changes caused by third-party platforms, hosting providers, search engines, advertising platforms, external software, or circumstances beyond our reasonable control.
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law where applicable.
14. Indemnity
To the extent permitted by law, you are responsible for claims arising from materials you provide, your unlawful use of our services, or your infringement of third-party rights. Any indemnity obligations will apply only to the extent permitted by applicable law and any relevant written agreement.
15. Suspension and Termination
Either party may terminate a project or service in accordance with the applicable written agreement. Where no specific termination terms have been agreed, the parties should communicate in writing to establish the applicable arrangements.
Upon termination, you remain responsible for fees for work completed, approved expenses, and other amounts payable under the applicable agreement and law. Any refunds, handover obligations, access arrangements, and transfer of deliverables will be handled in accordance with the relevant agreement and applicable law.
16. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to our website, services, business practices, or legal requirements. The latest version will be published on this page with an updated effective date where appropriate.
Changes to these website terms do not automatically override the specific terms of an existing signed agreement, except where permitted by that agreement or applicable law.
17. Governing Law
These Terms and Conditions are subject to the laws applicable in the relevant Australian jurisdiction in which Web Elevate operates, as determined by the applicable agreement and relevant legal requirements. Any disputes will be handled by the courts or tribunals with appropriate jurisdiction, subject to any mandatory rights or protections available under applicable law.
